When do you legally have to record a new deed in New Hampshire?
If “recording fees” are taxed according to the compensation given for real estate purchase ($15/thousand), and there was no cash involved, can the parties avoid the fees by simply not recording the deed (thus not having to buy the tax stamps)? If there is no deed, will the tax people come looking for the declaration of consideration?
Simmychick: The NH recording tax is assessed on both the seller and buyer, so it’s $15/thou; the question is when (if ever) MUST they record the deed (and pay the $6,000 fee in this bartered-for exchange)?
If the parties don’t record a new deed, then legally the previous owners are still the legal owners and would be responsible for property taxes. It’s in the new owners best interest to register a new deed showing them as the new owners.
